Effective Date: June 13, 2026

Erin Malone Media (doing business as Erin Colley Photography) (“we,” “us,” or “our”) respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you interact with us, particularly in connection with phone calls and SMS/text messages sent through third-party carriers for informational and marketing purposes.

By providing your phone number or consenting to receive calls or texts from us, you agree to the practices described in this Policy.

1. Information We Collect

We may collect the following categories of personal information:

Contact Information: Name, phone number, email address, mailing address, and other identifiers you provide.

Communication Preferences: Your consent or opt-in status for receiving phone calls and SMS/text messages.

Usage Data: Information about your interactions with our calls or texts (e.g., delivery status, open/click rates where available, opt-out requests).

We do not collect sensitive personal information (such as financial account numbers or government-issued IDs) solely for marketing communications unless required for a specific service.

2. How We Use Your Information

We use your personal information, including your phone number, for the following purposes:

Informational Communications: To send appointment reminders, booking confirmations, order updates, session details, or other service-related messages.

Marketing and Promotional Communications: To inform you about new services, special offers, events, photography sessions, portfolio updates, or other promotions via phone calls or SMS.

Customer Service: To respond to inquiries, provide support, or resolve issues.

Legal Compliance and Protection: To comply with applicable laws, enforce our agreements, or protect our rights.

3. Use of Third-Party Carriers for Calls and SMS

We use third-party service providers (outside carriers) to facilitate phone calls and SMS/text messaging. These providers may include platforms such as Grasshopper, or similar services (“Carriers”).

When you provide your phone number and consent, we share your phone number and message content with our Carriers solely for the purpose of delivering calls or texts on our behalf.

Our Carriers act as our service providers and are contractually obligated to use your information only as instructed by us and in compliance with applicable privacy and telecommunications laws.

We do not sell your phone number to third parties.

4. Consent for Calls and Texts

By voluntarily providing your phone number and expressly consenting (e.g., by checking a box, replying “YES,” or otherwise affirmatively agreeing), you authorize us and our Carriers to contact you using an automatic telephone dialing system (ATDS), artificial or prerecorded voice, or live calls for informational and marketing purposes.

You may receive calls and texts even if your number is on a national or state Do Not Call list, provided you have given prior express written consent.

Consent is not required as a condition of purchase.

How to Withdraw Consent (Opt-Out)

You may opt out of receiving marketing calls or texts at any time by:

Replying STOP, UNSUBSCRIBE, or QUIT to any text message.

Notifying us by email at erin@erincolleyphoto.com.

Using any opt-out link provided in our messages.

Once you opt out, we will honor your request promptly (typically within 10 business days for texts). Please note that opting out of marketing messages does not affect informational/service-related communications necessary for your bookings or orders.

5. Sharing Your Information

We may share your information with:

Third-party Carriers (as described above).

Service providers who assist with our operations (e.g., email platforms, CRM systems), under strict confidentiality agreements.

Legal authorities when required by law, subpoena, or court order.

We do not sell, rent, or trade your personal information for monetary consideration.

6. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your personal information. However, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security.

7. Data Retention
