Effective Date: June 13, 2026
By booking a photography session or using our services, you agree to the following terms. Specific details for your booking will be outlined in your signed Booking Agreement or Wedding Contract.
1. Bookings & Payments
A non-refundable retainer of 15% is required to secure your session date and time. This retainer will be applied toward your total fee.
Full payment is due according to the schedule in your contract.
We accept online payments, cash, and checks. A processing fee may apply to online payments.
Returned payments are subject to a $50 fee.
2. Cancellations & Rescheduling
Cancellations: The 15% retainer is non-refundable. Cancellation policies vary by service type and timing (see your signed contract for exact details).
Rescheduling: One complimentary reschedule is generally allowed with at least 3 weeks’ notice (subject to availability). Additional reschedules may incur a $50 fee.
Inclement Weather: Outdoor sessions may be rescheduled at no extra cost. The final decision rests with Erin Colley Photography.
3. Session Conduct & Late Arrivals
Clients are expected to arrive on time. Late arrivals will result in a shortened session without a reduction in fee.
No-shows will be treated as cancellations and full payment will be required.
4. Image Delivery & Gallery Access
Edited images are delivered via a secure online gallery.
Delivery timelines vary by service: typically 2–4 weeks for regular sessions and 8 weeks for weddings (a highlights gallery is provided sooner for weddings depending on chosen offering).
Clients have a limited time to download images after delivery (60 days for regular sessions, 6 months for weddings). After this period, galleries may be removed.
A re-upload fee of $50 may apply if access is needed later.
5. Artistic Vision & Editing
Erin Colley Photography maintains a distinctive artistic style. Final creative decisions regarding composition, lighting, posing, color grading, and editing are at the sole discretion of the photographer.
Re-edit requests are accepted only within 7 days of gallery delivery and are subject to approval and a $200 fee per round.
6. Copyright & Image Usage
All images are copyrighted by Erin Colley Photography.
Upon full payment, you receive a limited personal-use license to print and share images for non-commercial purposes (with photo credit where possible: @erincolleyphoto).
Commercial use, resale, or third-party licensing is prohibited without a separate written agreement.
7. Model Release
By booking, you grant Erin Colley Photography permission to use images from your session or wedding for portfolio, marketing, website, social media, and promotional purposes.
If you wish to opt out, you must submit a written request before the session.
8. Travel & Additional Fees
Travel fees apply for locations outside Columbia and Richmond County (or beyond 40 miles from Augusta, GA for weddings).
Additional fees may apply for extended time, overtime, special requests, or add-ons.
9. Liability
Our total liability shall not exceed the amount paid for the specific session or wedding package.
We are not responsible for lost, stolen, or damaged personal items, or for images missed due to guest interference, venue restrictions, or events beyond our control (Force Majeure).
11. Governing Law
These Terms & Conditions and your Booking Agreement are governed by the laws of the State of Georgia.
